 Post subject: Copyright queston re: covers of songs

Hey folks,
I'm trying to figure out a copyright issue. If I wanted to use a cover of a song (in this case "Skinhead Moonstomp" by Symarip) in my web series, who would I need to get clearance from? It's a not-for-profit web series, so I'm not standing to make money off it.
Ideally I'd prefer to use the original, but that seems a bit unlikely. Anyway, I'm just curious if anyone has any experience with this sort of thing!

That part is "only" important when it comes to the question how much you would pay.
I suggest you find the record company/the copyright owner (it's normally not the band) and ask for
a _written_ approval to use the song (under which conditions) for free.

Without the approval the copyright owner can charge you with a License fee or a copyright law suit etc.
Better be carful with it.

Going off past experience, ask the band that made the cover. They would(should) of asked the original rights holder's permission to cover the song, that permission includes reproduction rights regarding any soundtrack involvements.

Be nice when you ask and credit them at the end and you'll be fine, they'll want any PR they can get :)

Spectre: I wasn't clear, sorry! Skinhead Moonstop is a cover of Derrick Morgan's Moon Hop, but I was wondering if it would be cheaper/easier to record my own cover based on Symarip's version. It gets a little confusing and honestly probably isn't worth the headache.

As Frank points out there's a number of hoops to jump through and a fairly hefty price for doing it wrong. We'll see, I may still persue it just to see if I can swing it!

Yeah, and that's where it becomes an issue. I'd need permissions from both the rights holder to Moon Hop and rights holder to Skinhead Moonstomp.

Pretty sure it's too much work, especially as it would limit any future distribution of my miniseries. If *somehow* the miniseries was offered a distribution deal of some sort I'd have to renegotiate the music all over again...
