This is news to me but here is an article

'Recently, Ripple Junction has licensed the fan apparel and obtained the rights to mass-produce the product. And in return, Fox is shutting down all the mom and pop Jayne hat makers.'

Looks like because someone bought the rights and to cover their a$$es contractually speaking they are C&D'ing those that do not have the rights.

If someone bought the rights to sell USCM gear we'd probably get the same treatment.

Only issue I see is that for the last 10 years all those that want the hats probably already have them.
The fandom is dying down in terms of notability so I'm interested to see how sales will be.

Got my mom a cunning hat for Christmas off of Etsy. It'll be damn near impossible for FOX to cover all of those type bases as it were. Mom and pops usually have better quality imho than most "I bought the license buy my 'official' crap" kinda folks anyway so I bet the old cottage industry will carry on just fine if perhaps a bit more secretively.

Fox has been C&Ding on Etsy to a high degree in the past couple of weeks, and not just on Jayne hats...all manner of fan produced items.

Its actually stupid for Fox to be doing this because of the fan back lash, Ripple Effects wholesales to other retailer and they are selling the Jayne cap for about $20.00 which a lot of folks on etsy would have a hard time matching in any volume.

How can that hat, that's been around for a VERY long time before Firefly was, now be licensed by Fox??

There's plenty of fashion stores sell those style hats, in a variety of colours! Are they going to ban the selling of ALL orange ones? Utter nonsense.

Sell them online as orange winter hats and Fox got nothing

I can't see us being effected much unless Fox granted someone a licence to produce Armour, Motion Trackers, Grenades etc.

The problem is, they have to protect their licence - why would anyone pay Fox to produce licenced merchandise, if dozens of other companies churn out stuff and make extra profits? The infamous Disney actions of cease-and-desists on Kindergartens for painting Disney characters on their walls was not because they were evil, but because fake product manufacturers could possibly site these examples as defence in court cases.

The Jayne Hat though is a different animal, as these hats are generally available anyways, and not really character specific. It's not far removed from say HBO slapping copyright notices on producers of replica M42 Jumpsuits for infringing Band of Brothers copyright, something that's obviously unthinkable.

There's always the possibility that Fox may- at some future point attempt to do the same- based on some notional perceived need to protect the brand image or license of Aliens.

There's lots of sage commentary above which I entirely agree with: it's Fox's trademark/copyright to deal with as they see fit. If they feel that the homemakers of 'Jayne Hats' are creating an impact on their license, then they are legally entitled to deal with it as they see fit..... We can argue the right and wrong of it, but that's all there is to it.

The one 'wrinkle' that we as a community might want to be aware of is that some manufacturers have copyrighted not just their product but the distinctive shape/style of that product - Namely, Glock won lawsuits against S&W for infringing the copyrighted general shape of their pistol and it's general build style- It was not a substantiative copy of the design but looked similar enough externally to infringe the law....Subsequently Springfield's XD range has deliberately been styled to avoid such a suit.

My personal feeling is that it would be more likely to be something like this- armour that appears too much like the copyrighted 'image' or 'shape' of a 'Colonial Marine' that would result in any kind of legal action.....But as said before: it's unlikely to happen unless an 'officially licensed' Aliens armour, pulse rifle and sundries manufacturer suddenly appears.

When MR had the rights to make the motion tracker, I don't remember seeing any action being taken against anyone selling kits.
